These Terms and Conditions ("Terms") govern your access to and use of the Minet Botswana Yabotlhe Motor Lite Cover Portal ("Portal"), an online platform provided by Minet Botswana (Pty) Ltd ("Minet Botswana", "we", "our", or "us") for purposes of applying for, viewing, and managing insurance policies under the Minet Botswana Yabotlhe Motor Lite Cover ("Yabotlhe Motor Lite Cover").
By accessing or using the Portal, you ("User", "you", or "Client") acknowledge that you have read, understood, and agree to be bound by these Terms.
1.1 The Portal is available exclusively to individuals who are authorised participants of the Minet Botswana Yabotlhe Motor Lite Cover and who have been issued login credentials by Minet Botswana.
1.2 You agree to use the Portal solely for lawful purposes and only for managing your insurance policy(ies) under the Yabotlhe Motor Lite Cover.
1.3 You should not use the Portal on behalf of any third party unless expressly authorised by Minet Botswana.
2.1 You are responsible for maintaining the confidentiality of your username, password, and any other authentication methods provided by Minet Botswana.
2.2 Any activity conducted through your account will be deemed to have been carried out by you.
2.3 You agree to notify Minet Botswana immediately of any unauthorised access, suspected security breach, or compromised credentials.
2.4 Minet Botswana reserves the right to suspend or revoke access where misuse or security risks are detected.
3.1 You warrant that all information submitted through the Portal—including personal details, declarations, documentation, and policy information—is true, complete, and accurate.
3.2 You agree to promptly update your information should any details change.
4.1 Minet Botswana will take reasonable steps to ensure the availability, integrity, and security of the Portal.
4.2 Minet Botswana does not warrant uninterrupted access and is not liable for any downtime, system outages, delays, data loss, or interruption service.
4.3 Minet Botswana may modify, suspend, or discontinue the Portal (or any part thereof) for maintenance, security, legal compliance, or operational reasons, without prior notice.

5.2 Minet Botswana processes your personal data for the following lawful purposes:
5.3 Administering and managing your insurance application(s) and policy(ies);
5.4 Compliance with legal obligations under the Insurance Industry Act, 2015;
5.5 Fraud prevention, identity verification, and risk assessment;
5.6 Client servicing and communication regarding your policy.
6.1 The Portal may collect and process:
6.1.1 Identification data (e.g., name, ID/passport number, employee number);
6.1.2 Contact details;
6.1.3 Employment information;
6.1.4 Insurance, claims, and beneficiary information;
6.1.5 Financial and premium payment details;
6.1.6 Sensitive personal data where required for underwriting or claims (processed with appropriate safeguards).
Under the Data Protection Act, 2024, you have the right to:
7.1 Access your personal data;
7.2 Request correction or deletion of inaccurate or unlawful data;
7.3 Withdraw consent where processing is based on consent;
7.4 Object to certain forms of processing;
7.5 Request data portability where applicable.
7.6 Any other rights permitted by the Act.

Your personal data may be shared with:
8.1 Insurers and reinsurers underwriting your policy;
8.2 Regulated service providers (e.g., medical examiners, assessors, IT service providers);
8.3 Regulatory authorities including NBFIRA, Information and Data Protection Commission where legally required;
8.4 Third parties to whom Minet Botswana outsources operational or administrative functions under a binding confidentiality and data protection framework.
Minet Botswana will never sell your personal data to third parties.
Minet Botswana retains personal data only for as long as necessary to fulfil the purposes for which it was collected, or as required by law, including the Insurance Industry Act, 2015/ Financial Intelligence Act 2022 and statutory record-keeping obligations.
Minet Botswana implements appropriate technical and organisational measures to ensure the confidentiality, integrity, and availability of personal data, including encryption, secure servers, access controls, and regular audits.
11.1 All insurance applications, disclosures, underwriting, and policy management conducted through the Portal remain subject to the Insurance Industry Act, 2015 and its Regulations.
11.2 You acknowledge and agree that Minet Botswana may require additional documentation or verification to comply with legal and regulatory requirements, including statutory reporting obligations.
11.3 Any fraudulent misrepresentation or concealment of material facts may result in the rejection of claims or cancellation of cover as permitted under the Act.
12.1 All content, software, logos, and materials displayed on the Portal are owned by Minet Botswana and protected by intellectual property laws.
12.2 You may not copy, reproduce, distribute, or modify any part of the Portal without Minet Botswana's prior written consent.
You agree not to:
13.1 Use the Portal for fraudulent, unlawful, or unauthorised purposes;
13.2 Attempt to circumvent security measures or gain unauthorised access;
13.3 Upload malicious code, viruses, or harmful materials;
13.4 Interfere with the operation or integrity of the Portal.
14.1 Minet Botswana shall not be liable for indirect, incidental, special, or consequential damages arising from use or inability to use the Portal.
14.2 Minet Botswana's liability for direct damages shall be limited to gross negligence.
14.3 Nothing in these Terms limits liability arising from Minet Botswana's gross negligence, fraud, or wilful misconduct.
15.1 Minet Botswana may terminate or suspend your access immediately where:
· You breach these Terms;
· Your participation in the Yabotlhe Motor Lite Cover ends;
· Required by law or regulatory directive.
15.2 Upon termination, your right to use the Portal ceases immediately.
Minet Botswana may update these Terms from time to time. Continued use of the Portal constitutes consent to the updated Terms.
These Terms shall be governed by the laws of Botswana. Any disputes shall be resolved through negotiation, failing which the matter shall be referred to the competent courts of Botswana.
